Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Bullpen Boss mobile application (the “App”), available on the Apple App Store, and the website at bullpenboss.com (the “Site”). By accessing or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.
1. Who May Use Bullpen Boss
The App and Site are intended for adults and authorized youth baseball coaches or team staff. You represent that you are at least 18 years old (or the age of majority where you live) and that you have authority to enter team and player information you submit into the App for coaching purposes.
You are responsible for obtaining any parental, organizational, or league permissions required for the data you enter.
2. Service Availability
We strive to keep Bullpen Boss available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change, be added, or be removed over time. We may suspend or modify the App or Site for maintenance, security, or operational reasons.
3. The Service
Bullpen Boss helps coaches track pitch counts, plan tournament pitching, view arm status estimates based on entered data and published guidelines, and receive in-game recommendation prompts. The App is a coaching aid. It is not a medical device, not medical advice, and not a substitute for professional medical judgment, league officials, or your own coaching decisions.
Injury and safety. Recommendations and rest guidance are informational only. They do not guarantee that a pitcher will avoid injury, meet league rules, or achieve any competitive result. Coaches remain solely responsible for pitcher usage, rest, medical decisions, and compliance with applicable league, tournament, and safety rules.
4. Accounts, Local Data, and Accuracy
Much of your team and game data is stored locally on your device. You are responsible for the accuracy of information you enter and for safeguarding your device. We are not responsible for data loss if you delete the App, clear storage, lose your device, or experience device failure, unless required by law.
You agree not to enter information you are not authorized to use, and not to use the App for unlawful, harmful, or abusive purposes.
5. Free Trial, Subscriptions, and Paid Access
5.1 Free tournament trial
New teams may receive one free tournament before a subscription is required. The free trial includes tournament planning and live game features for that tournament only, subject to these limits:
- One free tournament per team account. Starting the free tournament is final; deleting or canceling it does not grant another free tournament.
- Up to seven (7) games in that tournament.
- The trial window ends when the tournament is marked complete, when the game cap is reached, or six (6) calendar days after the first live game in that tournament is started—whichever comes first.
After the trial ends, paid features for new games and tournaments are locked until you subscribe. Data you already entered for that tournament generally remains viewable in the App.
5.2 Subscription plans
Paid access is offered as auto-renewing subscriptions through the App. Current plans (prices in U.S. dollars, before applicable taxes):
- Basic — $49.99 per month or $399.99 per year. Tournament planning, arm status, recommended starters, and post-game pitch logging.
- Premium — $99.99 per month or $849.99 per year. Everything in Basic, plus live in-game tracking and in-game pitching recommendations.
Prices, plan features, and trial rules may change. The offer shown in the App at the time you subscribe (or in a written agreement with us) controls.
5.3 App Store purchases
Subscriptions purchased in the App are processed by Apple through In-App Purchase. Apple charges your Apple ID account. Payment, renewal, cancellation, and refunds for those transactions are also subject to Apple’s terms and policies. You can manage or cancel a subscription in your Apple ID account settings (Settings → Apple ID → Subscriptions on your device).
Subscriptions renew automatically until you cancel. If you cancel, access continues through the end of the current billing period unless a refund is issued under this section or applicable law. You may use Restore purchases in the App to recover an active subscription on a device tied to the same Apple ID.
5.4 Cancellation grace periods and refunds
If you are not satisfied with a paid subscription, you may request a full refund within the following periods from the date of your initial purchase or renewal charge for that subscription term: three (3) days for monthly subscriptions and ten (10) days for annual subscriptions. Contact kyle@bullpenboss.com with your team name, plan, and purchase date. For App Store purchases, we will help you request an eligible refund through Apple where appropriate; Apple’s refund policies may also apply. Outside these grace periods, fees are generally non-refundable except where required by law or by the platform’s policies.
5.5 Organizations and invoice billing
Travel organizations, clubs, or directors covering multiple teams may purchase at volume rates outside the in-app checkout. See our organization pricing page for current per-team rates. Email kyle@bullpenboss.com with your team count and plan needs; we will send an invoice (for example via Stripe). Organization pricing, team count, plan level, payment terms, and how access is activated will be confirmed in writing before payment. Each team’s access is provided as described in that agreement—typically by activating the coach email used during team setup in the App.
We may also activate or restore access manually when you contact kyle@bullpenboss.com for support or under an organization agreement.
6. Acceptable Use
You agree not to:
- Copy, reverse engineer, or resell the App except as allowed by law
- Interfere with or disrupt the Site or App
- Attempt to bypass trial, subscription, or access controls
- Use the App to harass anyone or to collect data for unrelated commercial lists
- Misrepresent your identity or affiliation when contacting us
7. Intellectual Property
The App, Site, branding, text, graphics, and software are owned by Bullpen Boss or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership to you. You receive a limited, non-exclusive, non-transferable license to use the App and Site for your team’s coaching purposes in accordance with these Terms.
8. Third-Party Services
The Site may link to or embed third-party services (for example, waitlist forms). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms.
9. Privacy
Our Privacy Policy explains how we handle information, including optional product improvement data if you opt in. By using the App or Site, you also acknowledge that policy.
10. Disclaimers
THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECOMMENDATIONS, CALCULATIONS, OR STATUS INDICATORS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PLAYER OR GAME SITUATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULLPEN BOSS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP, SITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BULLPEN BOSS FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow certain limitations. In those places, some of the above may not apply to you, and our liability is limited to the fullest extent allowed.
12. Indemnity
You agree to defend, indemnify, and hold harmless Bullpen Boss from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the App or Site, your violation of these Terms, or your coaching, medical, or roster decisions.
13. Termination
We may suspend or terminate access to the App or Site if you violate these Terms or if we discontinue the service. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Except where prohibited by law, you agree that courts located in Florida will have exclusive jurisdiction over disputes arising out of or relating to these Terms, the App, or the Site.
Before filing a claim, please contact kyle@bullpenboss.com so we can try to resolve the issue informally.
15. Changes
We may update these Terms by posting a revised version on this page with an updated effective date. Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
